Your rights and responsibilities when using Cosmetic AI

1. Acceptance of Terms

Welcome to Cosmetic AI! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Cosmetic AI ("we," "our," or "us") governing your access to and use of the Cosmetic AI mobile application ("App").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that:

  • You are at least 13 years old (or 16 in the EEA)
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the App under applicable laws
  • Your use of the App complies with all applicable laws and regulations

3. Description of Services

Cosmetic AI is a skincare and cosmetic product analysis application that provides:

  • AI-Powered Ingredient Analysis: Photo-based scanning and analysis of cosmetic product ingredient lists using OpenAI's GPT-4o-mini Vision AI
  • Safety Ratings: Health and safety scoring (0-10) and letter grades (A-F) for cosmetic products
  • Skin Type Compatibility: Evaluation of product compatibility with various skin types (Normal, Dry, Oily/Acne-Prone, Sensitive, Mixed)
  • Personalized Recommendations: Product suggestions and safer alternatives based on user preferences
  • Scan History & Dashboard: Tracking of scanned products with streak counting, average safety scores, and usage statistics

Important Limitations — Please Read Carefully

Analysis results are AI-generated estimates intended for informational purposes only. They are not medical facts, diagnoses, or professional dermatological assessments.

THE APP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The ingredient analysis, safety scores (0-10), letter grades (A-F), skin type compatibility assessments, and product recommendations provided by the App are AI-generated estimates based on computer vision analysis of product labels. These results may contain errors, inaccuracies, or omissions. You should not rely on the App's analysis as a substitute for professional dermatological or medical advice.

If you have any skin condition, allergy, sensitivity, or medical concern regarding your face or body, STOP using the App and consult a licensed healthcare provider or board-certified dermatologist. The App cannot assess your individual medical history, allergies, or skin conditions. Always perform a patch test before using any new cosmetic product. Never disregard professional medical advice or delay in seeking it based on information provided by the App.

By using this App, you acknowledge that all analysis results are AI-generated estimates and may not be accurate, complete, or up-to-date. Cosmetic formulations change, ingredient lists vary by region, and the AI may misinterpret product labels. You use the App at your own risk.

4. Free Tier and Subscriptions

4.1 Free Tier

Cosmetic AI offers a free tier that includes 1 free scan per day (resetting each day). We reserve the right to modify the free tier limitations at any time with reasonable notice.

4.2 PRO Subscriptions

Cosmetic AI PRO offers unlimited scans and premium features through auto-renewing subscriptions:

  • Billing: Subscriptions are billed through your Apple ID via RevenueCat
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period
  • Cancellation: You can manage and cancel subscriptions in your Apple ID Account Settings
  • Restore Purchases: You can restore previously purchased subscriptions from the App Settings at any time
  • No Refunds: Payments are non-refundable except as required by applicable law. No refunds or credits for partial subscription periods
  • Price Changes: We reserve the right to modify subscription pricing with prior notice. Price changes will take effect at the next renewal period

5. User Content and Data

5.1 Your Content

You retain all ownership rights to any content you submit through the App, including product photos, ingredient label images, personal skincare preferences, and usage history.

5.2 License to Use Content

By submitting content to the App, you grant us a limited, non-exclusive, royalty-free license to use, process, and analyze your content solely for the purpose of providing and improving the services. This license terminates when you delete your content or cease using the App.

5.3 Data Storage and Privacy

Your personal data and scan history are stored locally on your device by default using AsyncStorage. Certain data is processed through third-party services (OpenAI for ingredient analysis, RevenueCat for subscriptions) as described in our Privacy Policy.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Use the App for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App, user accounts, or computer systems
  • Interfere with or disrupt the integrity or performance of the App
  • Use the App to provide medical or dermatological advice to others
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices
  • Use automated means (bots, scrapers, crawlers) to access or interact with the App
  • Upload or transmit viruses, malware, or any malicious code

7. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to the software, design, trademarks, logos, trade dress, and all intellectual property rights, are owned by Cosmetic AI or its licensors.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes on devices that you own or control.

8. Third-Party Services

The App integrates with the following third-party services to provide core functionality:

  • OpenAI (GPT-4o-mini): AI-powered product image and ingredient analysis. Product photos are uploaded to OpenAI for analysis — uploaded product images may be processed by third-party AI providers to generate ingredient analysis. Images are processed transiently and are not stored by us.
  • RevenueCat: Subscription management, entitlement verification, purchase processing, and purchase restoration.
  • Apple App Store: Payment processing, app distribution, and platform services (iOS only).
  • Vercel: API proxy hosting for secure OpenAI requests (the OpenAI API key never lives in the app binary).
  • Expo (EAS): App build infrastructure, crash reporting, and performance monitoring.

9. Disclaimers and Limitations of Liability

9.1 No Medical or Dermatological Advice

ALL ANALYSIS RESULTS ARE AI-GENERATED ESTIMATES INTENDED FOR INFORMATIONAL PURPOSES ONLY. The App does not provide medical advice, diagnosis, or treatment. The ingredient analysis, safety scores (0-10), letter grades (A-F), skin type compatibility assessments, product recommendations, and all other output from the App are AI-generated estimates produced by computer vision analysis of product labels. These results may be inaccurate, incomplete, or outdated.

If you have any skin condition, allergy, sensitivity, irritation, or any medical concern regarding your face, skin, or body, do not rely on this App — consult a licensed healthcare provider or board-certified dermatologist. Always perform a patch test before using any new cosmetic product. Never disregard professional medical advice or delay in seeking it based on information provided by the App.

You acknowledge that you use the App at your own risk and that Cosmetic AI is not responsible for any adverse reactions, allergies, skin irritations, or other damages resulting from your use of products analyzed through the App.

9.2 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COSMETIC AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.

9.4 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO US, IF ANY, IN THE PAST 12 MONTHS, OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Cosmetic AI and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of and access to the App, your violation of any term of these Terms, or your violation of any third-party right.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before filing any claim, you agree to attempt to resolve any dispute informally by contacting us at avishka200411243@gmail.com. We will attempt to resolve the dispute through good faith negotiation within 30 days of receiving your notice.

11.3 Class Action Waiver

YOU AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

12. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. If you wish to stop using the App, you may simply discontinue use or delete the App from your device.
